D/B/A ODYSSEY (“Odyssey,” “we,” “our,” or “us”) respects your privacy and is committed to protecting the personal information we collect through our website, applications, and online services that link to this Privacy Policy (collectively, the “Site”). This Privacy Policy explains how we collect, use, disclose, and protect personal information collected through the Site, as well as the choices and rights available to you.

This Privacy Policy applies to information collected online from Site visitors, users, customers, prospective customers, parents and legal guardians who use the Site on behalf of their children, and other individuals who interact with us through the Site. The Site is intended for users located in the United States; if you access the Site from outside the U.S., you acknowledge that your information will be transferred to and processed in the United States. It does not apply to information collected in the employment or job applicant context, which may be governed by a separate notice.

Personal Information We Collect

Depending on how you interact with the Site, we may collect the following categories of personal information:

Identifiers and contact information, such as: name, username, email address, mailing address, phone number, account credentials, and customer or account identifiers
Personal records and profile information, such as: date of birth, country of residence or national origin, education-related information, employer and employment history, professional references, and hand-signed signature
Protected or sensitive information, with your consent and where voluntarily provided or required for a requested service, such as: government-issued and similar identifiers, where relevant to the services requested or forms submitted, such as Social Security Number, driver’s license or state identification number, age, sex, racial or ethnic origin, disability-related information, financial account information, payment card information, information contained in documentation you provide to us, and health and medical information about your child (such as doctor’s notes, medical documentation, diagnoses, allergies, medications, and treatment- or accommodation-related information) that you submit to us in your capacity as a parent or legal guardian
Information about your child, where you use our services as a parent or legal guardian on your child’s behalf, such as the child’s name, date of birth, school, grade level, and any medical, health, or accommodation-related information (including doctor’s notes and other medical documentation) you choose to provide
Commercial and transaction information, such as: records of products or services purchased, donation history, and transaction-related details
Internet and network activity information, such as: IP address, browser type, language, version, operating system and platform, device and network information, and pages viewed
User-submitted content and communications, such as: information you enter into webforms, messages sent through contact forms, chat messages, transcripts, attachments, and timestamps, and information you provide when requesting information or support and
Inferences, drawn from any of the above to create a profile reflecting your preferences, characteristics, or behavior

Sources of Personal Information

We collect personal information:

Directly from you, such as when you create an account, fill out a form, submit information through a chat tool, make a purchase, request information, or communicate with us;
Automatically, through cookies, logs, analytics, session replay tools, and similar technologies when you use the Site; and
From other sources, such as public sources, state agencies, service providers, and transaction or payment partners; and
From parents and legal guardians, who provide information about themselves and their children when using our services on a child’s behalf, including any medical, health, or accommodation-related information (such as doctor’s notes) they choose to submit.

Cookies, Web Beacons, Links, And Other Tracking Technologies

Odyssey may keep track of how you use and interact with the Site and of your interaction with communications and information we provide to you about the Site through the use of cookies, web beacons, links, and other tracking technologies. A cookie is a small text file that our Site saves onto your computer or device when you use the Site that provides us certain information about your activities. Cookies allow the Site to remember your actions and preferences and recognize you or your browser. Web beacons / pixel tags are small graphics on a webpage that monitor your activity when viewing a webpage.

We do this to help analyze the use of and improve the Site. Through these technologies we may automatically collect information about your use of the Site and other online activities, including our email correspondences, third-party services, and client applications, and certain online activities after you leave the Site. Link information is generally only analyzed on an aggregate basis. Some features on the Site may not function properly if you disable cookies.

The tracking technologies on our Site may collect information such as:

the IP addresses assigned to the computers and other devices you use;
your internet service provider;
the device ID number;
approximate geographic location;
the Site pages visited or clicked on;
the date and time you visited the Site, and the amount of time spent on the Site;
your operating system, browser type, search requests, and other similar information;
the websites you access before and after visiting the Site, and
data related to how and when you use the Site.

Unique Identifiers: When you use or access the Site, we may access, collect, monitor, store on your device, and/or remotely store one or more "Unique Identifiers," such as a universally unique identifier (“UUID”). A Unique Identifier may remain on your device persistently, to help you log in faster and enhance your navigation through the Site. Some features of the Site may not function properly if use or availability of Unique Identifiers is impaired or disabled.

Log File Information: When you use our Site, we may receive log file information such as your IP address, browser type, access times, domain names operating system, the referring web page(s), pages visited, location, your mobile carrier, device information (including device and application IDs), search terms, and cookie information. We receive log file data when you interact with our Site, for example, when you visit our websites, sign into our Site, or interact with our email notifications. Odyssey uses log file data to provide, understand, and improve our Site, and to customize the content we show you. Odyssey may link this log file to other information Odyssey collects about you via the Site.

Public Information: Odyssey may also collect information about you from publicly available sources. Information you make publicly available in any public or open forum, such as on a social network, may be considered public information for the purposes of this Privacy Policy, and may be accessed and collected by Odyssey. Please be aware that any content or information you share with or provide to third parties using or related to your use of the Site is neither private, nor confidential. Odyssey is not responsible for any content or information you post or share with third parties. If you do not wish for certain information to be public, please do not share it.

Some Site features may include third-party tools or embedded content, such as chat tools, maps, checkout functionality, or other widgets. Those providers may collect information directly through their integrations, and their collection and use of that information is governed by their own privacy policies, not this one.

Global Privacy Control

You can use the Global Privacy Control (“GPC”) through a supported browser to signal certain of your opt-out preferences. You may opt out processing of your Personal Information for purposes that constitute a “sale” or “share” for targeted advertising under applicable law, by broadcasting the Global Privacy Control signal through a supported browser. We honor GPC signals as a valid opt-out request for the browser from which the signal is received, even though, as described in Section 4, we do not currently engage in such sales or sharing. If you use the GPC, we will process your request for your browser, but it will not apply outside of that browser to your device. You will need to use the GPC for each browser you use to access the Site. If you clear your cookies in your browser after using the GPC, you will need to use the GPC again for us to process your opt out for that browser.

Do Not Track

Odyssey does not currently employ a process for automatically responding to “Do Not Track” (DNT) signals sent by web browsers, mobile devices, or other mechanisms. Per industry standards, third parties may be able to collect information, including Personal Information, about your online activities over time and across different websites or online services when you use the Site.

You may opt out of online behavioral ads at http://www.aboutads.info/choices/. You also may limit certain tracking by disabling cookies in your web browser.

How We Use Personal Information

We may use personal information for the following purposes:

to provide, operate, maintain, and improve the Site and our services;
to create and manage user accounts;
to process transactions and facilitate purchases through third-party payment or checkout providers;
to respond to inquiries, requests, and support needs;
to communicate with you about services, transactions, updates, and administrative matters;
to send text messages or other communications you have agreed to receive;
to personalize user experience and better understand how the Site is used;
to monitor, troubleshoot, secure, and debug the Site;
to detect, investigate, and prevent fraud, misuse, security incidents, and other harmful activity;
to review, evaluate, and act on health, medical, accommodation, or eligibility-related information that parents or legal guardians submit on behalf of their children, such as doctor’s notes provided in connection with our services;
to comply with legal obligations, enforce our terms, and protect our rights and interests; and
for any other purpose disclosed at the time of collection or with your consent.

Sensitive Personal Information: We use Sensitive Personal Information (as defined under California law) only for the purposes permitted by Cal. Civ. Code § 1798.121 and applicable regulations, including: performing the services you request; verifying your identity; detecting and preventing security incidents and fraud; ensuring the physical safety of individuals; short-term, transient use; performing services on our behalf; and verifying the quality or safety of our services. We do not use Sensitive Personal Information to infer characteristics about you. Where parents or legal guardians submit health or medical information about their children (such as doctor’s notes or other medical documentation), we use that information only for the specific purpose for which it was provided such as to evaluate, accommodate, or document a request related to the child’s participation in our services—and we retain and disclose it consistent with this Privacy Policy and applicable law, including the Children’s Online Privacy Protection Act (“COPPA”). How We Disclose Personal Information

We may disclose personal information to the following categories of recipients:

Service providers and contractors that perform services on our behalf, such as website hosting, payment processing, communications, customer support, analytics, security, chat functionality, and related services;
Marketplace, fulfillment, or transaction partners involved in processing purchases or providing requested services;
Professional advisors such as lawyers, auditors, consultants, and insurers;
Government entities, regulators, law enforcement, or other third parties when required by law, legal process, or to protect rights, safety, and property;
Parties involved in a corporate transaction, such as a merger, acquisition, financing, restructuring, or sale of assets; and
Other parties with your direction or consent.

We do not sell personal information. We also do not share personal information for cross-context behavioral advertising or targeted advertising as those terms are defined in certain state privacy laws.

Chat Features and User-Entered Information

If you use a chat or messaging feature available through the Site, we may collect the contents of your communications, including messages, files or attachments you submit, timestamps, and related metadata. Please do not submit highly sensitive information (such as Social Security Numbers, government IDs, or health or financial account details) through chat unless specifically requested by us through a secure channel. When we request medical or health documentation (such as a doctor’s note) for a child, please submit it only through the designated upload feature or other secure channel we identify, and not through chat.

Payments and Third-Party Checkout

Purchases or donations made through the Site may be processed through third-party payment or checkout providers. We do not store full payment card information on our own systems unless specifically stated at the point of collection. Payment information submitted through a third-party provider is subject to that provider’s privacy practices and terms.

Children’s Privacy

Some of our services are designed for use by parents and legal guardians on behalf of their children, including children under the age of 13. In those cases, the parent or legal guardian provides information about the child which may include health or medical information such as doctor’s notes or other medical documentation, and the parent’s or legal guardian’s submission of that information serves as the verifiable parental consent required under the Children’s Online Privacy Protection Act (“COPPA”). We collect and use information about children only for the purposes for which a parent or legal guardian provides it and as otherwise described in this Privacy Policy, and we do not condition a child’s participation in any activity on the disclosure of more personal information than is reasonably necessary.

Our Site is not directed to children under the age of 13, and we do not knowingly collect personal information directly from children under 13 without verifiable parental consent. Where we have actual knowledge that we are collecting personal information online from a child under 13, we will comply with applicable law, including obtaining any required parental or guardian consent under the Children’s Online Privacy Protection Act (COPPA). If you believe a child has provided personal information through the Site in a manner inconsistent with this Privacy Policy or applicable law, please contact us so we can review and delete the information.

Parents and legal guardians may, at any time, review the information we have collected about their child, request that we delete it, or refuse to permit further collection or use of their child’s information by contacting us using the information in Section 13. We may need to verify the identity of the parent or legal guardian before acting on the request.

Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to provide services, maintain accounts, complete transactions, comply with legal obligations, resolve disputes, enforce agreements, and protect our business. Retention periods vary based on the nature of the information, the context in which it was collected, and applicable legal, regulatory, contractual, and operational requirements. Generally, we retain account information for the duration of your account plus a reasonable period thereafter; transaction records for the period required by tax, accounting, and consumer-protection laws (typically up to seven years); and marketing records until you opt out or the information is no longer relevant. When personal information is no longer needed, we will delete, de-identify, or anonymize it, except where retention is required by law.

Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information appropriate to the nature of the information and the risks involved. However, no method of transmission over the internet or electronic storage is completely secure, and we cannot guarantee absolute security. In the event of a security incident affecting your personal information, we will notify you and applicable authorities as required by law.

Your Privacy Rights

Depending on where you live and the laws that apply, you may have certain statutory data protection rights regarding your personal information. These rights may be subject to exceptions and limitations under applicable law.

You may have the right to:

be informed of what personal data we hold about you and request access to and/or a copy of it;
request that we correct personal information that is inaccurate or incomplete;
request that personal information be removed from our systems (deleted), subject to certain exceptions;
request a portable copy of certain personal information;
opt out of certain processing of your personal information, including (where applicable) targeted advertising, and the sale or sharing of personal information (as those terms may be defined by applicable law);
withdraw your consent at any time where we process personal information based on your consent (this will not affect the lawfulness of processing before you withdrew consent);
not be discriminated against for exercising your rights (where applicable); and
appeal a decision we make about your request (where applicable under U.S. state law).

Sale/Sharing for targeted advertising: Odyssey does not sell personal information. Odyssey does not share personal information for cross-context behavioral advertising (also called targeted advertising) as those terms may be defined under certain U.S. state privacy laws.

Sensitive personal information: Odyssey uses sensitive personal information only for purposes such as providing services, credentialing, security, fraud prevention, and compliance with law, as described above, and not to infer characteristics about you for targeted advertising.

Authorized agents (where applicable): In some U.S. states, you may designate an authorized agent to submit a request on your behalf. If you use an authorized agent, we may ask for proof that the agent is authorized, and we may also require you to verify your identity directly with us.

Appeals (where applicable): If we deny your request, you may have the right to appeal our decision. We will verify your identity before processing certain requests, typically by matching information you provide with information we already have on file. We will respond within 45 days of receipt of a verifiable request, with a possible 45-day extension where reasonably necessary and with notice to you.

Marketing Communications

You may opt out of promotional emails by using the unsubscribe link included in the message. Even if you opt out of promotional communications, we may still send you transactional or relationship messages, such as account, service, or purchase-related communications. Please allow up to 10 business days for opt-out requests to take effect.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. When we do, we will post the updated version on the Site and revise the “Last Updated” date above. For material changes, we will provide additional notice, such as by email or a prominent notice on the Site, before the changes take effect. Your continued use of the Site after any update means you acknowledge the revised Privacy Policy, to the extent permitted by law.
